Welcome to LoriCabral.com (the “Site”), operated by Lori Cabral Real Estate (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our Site, including any content, functionality, and services offered on or through LoriCabral.com, whether as a guest or a registered user.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.2 Please read these Terms carefully before you start to use the Site. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site.

1. Services Offered

LoriCabral.com is a real estate agent website serving buyers and sellers in Northern California. Our Site provides:

• Real Estate Listings (IDX): We display real estate listings through an Internet Data Exchange (IDX) feed powered by HomeASAP. These listings are provided by various Multiple Listing Services (MLS) and are subject to the rules and regulations of those MLS organizations.
• Lead Collection (CRM): We utilize High Level as our Customer Relationship Management (CRM) system to collect information from users who voluntarily provide it, such as through contact forms, inquiries, or registration for saved searches. This information is used to facilitate communication and provide real estate services.

2. Use of the Site

• Eligibility: You must be at least 18 years old to use this Site. By using the Site, you represent and warrant that you are of legal age to form a binding contract with4 Lori Cabral Real Estate.
• Permitted Use: The content on this Site, including real estate listings, is provided for your personal, non-commercial use only. You may not use the Site for any purpose other than to identify properties for potential purchase or sale, or to connect with Lori Cabral Real Estate for real estate services.
• Prohibited Conduct: You agree not to:

• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Site, or access to the Site5 for any commercial purpose without our express written permission.
• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
• Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Lori Cabral Real Estate or users of the Site or expose them to liability.
• Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.

3. Real Estate Listing Data (IDX)

• Data Accuracy: The real estate listing data displayed on LoriCabral.com is provided by third-party MLS organizations via HomeASAP. While we strive to ensure the accuracy of the information presented, we cannot guarantee its completeness or accuracy. All information should be independently verified.
• Listing Attribution: All IDX listings displayed on this Site will clearly identify the listing broker and agent as required by MLS rules and regulations. The contact information provided for the listing broker is the responsibility of the MLS and is not managed by Lori Cabral Real Estate.
• Personal Use Only: The IDX data is for your personal, non-commercial use. You may not use it for any purpose other than identifying prospective properties to purchase or sell.
• Changes to Listings: Property listings are subject to change, withdrawal, or prior sale at any time without notice.

4. Lead Collection and CRM (High Level)

• Information You Provide: When you submit information through forms on our Site (e.g., contact forms, property inquiry forms, saved search registrations), you consent to Lori Cabral Real Estate collecting and storing this information in our High Level CRM system.
• Use of Information: The information collected through our CRM is used solely for the purpose of providing real estate services, including communicating with you, understanding your real estate needs, and facilitating transactions.
• No Sharing Outside Lori Cabral Real Estate: We will not share your contact information with third parties outside of Lori Cabral Real Estate without your explicit consent, except as required by law or to facilitate the specific real estate services you request (e.g., sharing with a lender or escrow company as part of a transaction). For details on how we handle your personal data, please refer to our Privacy Policy.
• Communications: By providing your contact information, you agree to receive communications from Lori Cabral Real Estate via email, phone calls, and/or text messages regarding your inquiries, property updates, and real estate services. You may opt-out of these communications at any time by following the unsubscribe instructions in our emails or by contacting us directly.9 Standard message and data rates may apply.

5. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software,10 text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Lori Cabral Real Estate, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish,11 download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those12 materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.13

6. Disclaimer of Warranties

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN “AS14 IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER15 LORI CABRAL REAL ESTATE NOR ANY PERSON ASSOCIATED WITH LORI CABRAL REAL ESTATE MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

WITHOUT LIMITING THE FOREGOING, NEITHER LORI CABRAL REAL ESTATE NOR ANYONE ASSOCIATED WITH LORI CABRAL REAL ESTATE REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT16 MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.17

Lori Cabral Real Estate hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

7. Limitation of Liability

IN NO EVENT WILL LORI CABRAL REAL ESTATE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING18 BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

8. Indemnification

You agree to defend, indemnify, and hold19 harmless Lori Cabral Real Estate, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Service or your use of20 the Site, including, but not limited to, your User Contributions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms21 of Service, or your use of any information obtained from the Site.

9. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California,23 in each case located in the county where Lori Cabral Real Estate primarily operates, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction24 over you by such courts and to venue in such courts.

10. Changes to the Terms of Service

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

11. Entire Agreement

These Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and Lori Cabral Real Estate regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
